  • Aggravated Vehicular Homicide
  • Aggravated Murder

Class B Felonies

  • Manslaughter II
  • Assault II
  • Kidnapping II
  • Robbery II
  • Rape II
  • Sodomy II
  • Sexual Abuse II
  • Promoting Child Sexual Abuse II

Class A Misdemeanors

  • Criminal Mistreatment I (when victim is a child or elderly person)
  • Invasion of Personal Privacy I
  • Endangering the welfare of a minor (sexual conduct)

Other Ineligible Offenses

  • Most traffic crimes (handled separately under traffic court procedures)
  • Crimes requiring sex offender registration
  • Any crime with an outstanding balance on fines/restitution (must pay first)
  • Any crime with pending charges or probation/parole violations
  • Crimes where the victim was a child and the offense was sexual in nature
